Terms of Service

These Terms govern access to and use of MarginBusiness Leads, including its lead intelligence, AI-assisted analysis, campaign tools and email-provider integrations.

Business-use service. MarginBusiness Leads is intended for organisations and authorised business users aged 18 or over.

1. Agreement and provider

These Terms of Service (“Terms”) form a legally binding agreement between the organisation or individual accepting them (“Customer”, “you”) and MarginBusiness FZE LLC, Ajman Free Zone, United Arab Emirates (“MarginBusiness”, “we”, “us”). The software is marketed as MarginBusiness Leads or Margin Leads.

By creating an account, purchasing a plan, joining a pilot or using the Service, you accept these Terms. If you act for an organisation, you confirm that you have authority to bind it.

2. Accounts and authority

  • Provide accurate account information and keep it current.
  • Protect login credentials and promptly report suspected unauthorised access.
  • Use only accounts and provider credentials you are authorised to use.
  • You are responsible for activity performed through your workspace.

3. The Service

The Service may include lead importing, workspace isolation, opportunity analysis, AI-assisted drafting, campaign preparation, email sending controls, provider integrations, credits, activity records and analytics.

Features may be changed, limited or removed. Beta features may be incomplete and may contain defects. We use reasonable efforts to maintain availability but do not guarantee uninterrupted or error-free operation.

4. Acceptable use

You must not use the Service to:

  • send unlawful, deceptive, fraudulent, abusive or misleading communications;
  • send spam or contact persons you are not legally permitted to contact;
  • upload stolen, unlawfully obtained or unnecessarily sensitive personal data;
  • impersonate others or present assumptions as verified facts;
  • circumvent sending limits, security controls or provider restrictions;
  • reverse engineer, copy, resell or distribute the Service without written permission;
  • introduce malware or interfere with another workspace or the platform.

5. Email and outreach compliance

You remain responsible for every recipient, message and campaign sent through your workspace.

You must determine whether you have a lawful basis or other valid permission to contact each recipient and must comply with applicable privacy, marketing and electronic-communications laws.

  • Use accurate sender details and a valid reply address.
  • Provide and honour opt-outs where required.
  • Do not use harvested or unauthorised consumer lists.
  • Maintain evidence supporting factual claims in outreach.
  • Use your own authorised email-provider account unless otherwise agreed in writing.

MarginBusiness does not provide legal clearance for your campaigns.

6. AI-generated outputs

AI features may generate analysis, classifications, summaries, subject lines, emails and recommendations. Outputs may be inaccurate, incomplete or unsuitable. You must review and approve all outputs before use.

AI output is not legal, financial, tax or compliance advice. We do not guarantee replies, meetings, sales, deliverability, revenue or profit.

7. Third-party services

The Service may rely on authentication, hosting, database, AI, payment and email-delivery providers. Supported email providers may include Brevo, SendGrid, Resend and Mailgun and may change over time.

You are responsible for your relationship with your chosen provider, including its fees, authentication, limits and acceptable-use rules. Provider outages, suspensions and delivery decisions are outside our control.

8. Fees, credits and beta plans

Fees, limits, credits and plan features are shown at purchase or agreed in writing. Unless stated otherwise, fees are charged in advance and are non-refundable except where required by law. Credits have no cash value, are not transferable between unrelated workspaces and may reset or expire according to the plan.

Beta and founding pricing may be changed or withdrawn on reasonable notice. Taxes and third-party provider charges are your responsibility.

9. Customer data

You retain ownership of data you submit. You grant us a limited right to host, process and transmit it as necessary to provide, secure and support the Service.

You warrant that you have all rights and permissions needed to submit Customer Data. For lead and recipient data, you generally act as controller and MarginBusiness acts as processor. You are responsible for lawful collection, retention, deletion and rights handling.

10. Intellectual property

MarginBusiness retains all rights in the Service, software, interface, prompts, analysis frameworks, documentation and branding. You receive only a limited, non-exclusive, non-transferable right to use the Service during an active plan or pilot.

11. Security

We use reasonable technical and organisational safeguards, including authenticated access, workspace isolation and encrypted provider credentials. No system is completely secure. You must protect accounts, limit access and report suspected incidents promptly.

12. Suspension and termination

We may suspend or terminate access for non-payment, breach, unlawful activity, security or deliverability risk, provider requirements or material harm to the Service or others. Where reasonable, we will provide notice and an opportunity to remedy the issue.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.

14. Limitation of liability

To the maximum extent permitted by law, MarginBusiness will not be liable for indirect, incidental, special, punitive or consequential loss, or loss of profits, revenue, business, goodwill, data or opportunity.

Our aggregate liability relating to the Service will not exceed the fees paid for the Service during the six months immediately preceding the event giving rise to the claim. Nothing limits liability that cannot lawfully be limited.

15. Indemnity

You will indemnify MarginBusiness and its personnel against claims, losses, penalties and reasonable costs arising from your Customer Data, recipient lists, campaigns, provider accounts, breach of these Terms or violation of law or third-party rights.

16. Governing law

These Terms are governed by the laws of the United Arab Emirates and, where applicable, the Emirate of Ajman. Courts with jurisdiction in Ajman will have exclusive jurisdiction unless mandatory law requires otherwise.

17. Changes

We may update these Terms to reflect legal, technical, security or commercial changes. The updated version will be published with a revised effective date.
